We interrupt the discussion of the ketuba for this case, just received – a sarvan get finally relents

I'll start out with the "happy end", dated today, May 8, 2013, and then we'll see if you think it is really that.

לאחר מתן ההחלטה מתאריך כ"ו באייר תשע"ג (6.5.2013) הגט סודר ונמסר כדמו"י בו ביום.

After issuance of the decision from May 6, 2013, the get was arranged "according to the laws of Moshe and Israel" on that same day.

What got this guy to give the get, and after how much time?  Here is the decision (loosely translated) from May 6th (Haifa):

א.       בית הדין ניסה רבות לעשות בתיק זה כדי להביא את הצדדים לידי פשרה, אולם ללא הצלחה.
ב.      בית הדין סבור כי יש להמשיך במאמצים כדי לשכנע את הבעל לתת גט מרצון, ולצורך כך בית הדין מזמן את הבעל למחר יום שלישי כ"ז באייר תשע"ג 7.5.2013 בשעה 8.30 בבוקר, ואם ניסיונות השכנוע לא יצלחו, הרי הבעל יתייצב כאן בכל בוקר בשעה 8.30 לדיון בפני בית הדין.
ג.       בשלב זה האשה אינה צריכה להתייצב, אולם עליה להשאיר במזכירות בית הדין פרטי התקשרות עמה, למקרה בו ייאות הבעל לתת גט – או אז היא תוזמן מידית.
ד.      הבעל הצהיר לפני בית הדין כי אין בדעתו להתייצב מחר, לאור ההתחייבויות שיש לו כלפי לקוחותיו במשרד, במקצועו כעורך דין. ראשית, בית הדין סבור כי התרת אשתו מעגינותה הנמשכת קרוב לעשור, קודמת לכל התחייבות אחרת, ושנית על הבעל להבין כי חסד נעשה עמו באשר אחד הצעדים הבאים יכול שיהיו כדוגמת שלילת רישיונו בעיסוקו במקצוע עריכת הדין, על פי חוק בתי דין רבניים (קיום פסקי דין של גירושין) התשנ"ה–1995, ולכן ביטול פגישות עם לקוחות, היא פגיעה פחותה מכל אפשרות אחרת.
ה.      אולם, לאור הצהרת הבעל כאמור, ולשם הבטחת הופעתו, בית הדין אינו רואה ממנוס, מהזמנתו בצו הבאה ע"י משטרת ישראל.
ו.        יחד עם זאת, ניתן יהיה להמיר את צו ההבאה בהפקדת מזומן בסך 150,000 ₪ כערובה להתייצבות הבעל מחר ובכל יום אחר שהוא יוזמן אליו על פי החלטת בית הדין.
על משטרת ישראל להביא את הבעל מחר לדיון כאמור בסעיף ב', ואין לשחררו ללא אישור מפורש מבית הדין.
ניתן ביום כ"ו באייר התשע"ג (06/05/2013) .


  1. The beit din has tried extensively to bring the sides to a compromise, with no success.
  2. The beit din maintains that it should continue efforts to convince the husband to give the get willingly, and for this purpose, he is requested to appear tomorrow at 8:30 am, and if the efforts to convince him do not succeed, he must appear every morning at 8:30 am, for a hearing before the beit din.
  3. At this stage, the wife does not need to appear, but she must leave contact information with the secretary, in case the husband sees fit to give the get, and then she will be requested to come immediately.
  4. The husband declared that he has no intention of appearing, because of his commitments to his clients in his office; professionally he is an attorney.  First of all, the beit din maintains that releasing his wife from being an aguna [yes! they use this term - see my introductory post on this matter], which has dragged on for almost a decade [my emphasis], takes precedence over all other obligations.  Second of all, the husband must understand that this is a favor that is being done for him [to order him to appear before the beit din to try to resolve the matter] because one of the next steps might be such as invalidating his license to practice law, according to the 1995 law for batei din, and therefore cancelling appointments is the lesser damage than other options.
  5. But, considering the husband's declaration [that he will not appear], and in order to insure his appearance, the beit din sees no alternative but to request his appearance with an order of a police escort.
  6. In place of the police escort, the husband can deposit 150,000 NIS in escrow, to be certain that he appears tomorrow and any other day that he is requested by the beit din to appear.
The police must bring him tomorrow, as instructed in paragraph 2, and should not release him without specific instructions from the beit din.

OK.  So the husband was convinced that the beit din means business.  I am sincerely happy for the woman, who was finally released from bondage.  She has reason to celebrate.  But why did it take almost ten years for this to happen?  And what if he is the type of lawyer for whom 150,000 NIS is pocket change?  (There are lawyers like that.)  Then how much longer would it drag on? 

That's why I don't think the rest of us have any cause to celebrate - not those of us who believe that freedom of choice - to whom we are married and if we want to stay married - is a basic human right. Not for those of us who believe that a halakhic system has to be just and moral.  Otherwise, it should be scrapped, here and now.

  1. No cause for celebration when the Beit Din allows a man to keep his wife in bondage for _ten years_. They should have pressured him like this from the first day he refused. They failed in their obligation to protect the wife's rights.

    1. Yes, they should have pressured him from the beginning. But I see fault in a system in which a woman has to rely on the beit din to do this. They have failed - as a system - way too many times to be trusted to fulfill this "obligation" to protect the wife's rights. We don't know the case for this divorce, but remember, it is not a system that accepts the "no-fault" concept. In this case, the beit din must have agreed that the husband is "at fault" to rule that he should give a divorce. If her rights include the choice to exit a marriage that is not good for her - for whatever reason, then they do not perceive any such obligation to protect her rights. I do not view this as a failure in what is usually a good system. I view it as one proof, our of innumerable proofs, of a failed system.

  2. As you are well-aware, a Beit Din has the ability to force a husband to give a get, while maintaining the legal fiction that it was given willingly. Unfortunately, in this day and age when corporal punishment is not easily applied, the Poskim have not stepped up to offer alternative methods. It should be possible to keep within the letter of the law while still allowing women to divorce as they choose.

Corporal punishment has not been allowed under Ashkenazi pesak for centuries, and Ashkenazi pesak rules in these matters in Israel (because if Rambam's view that you could beat someone - never mind the problem of corporal punishment today - were used, some poskim would not consider the get kosher). Nevertheless, they do have an alternative method - it is called throwing a guy in jail. They do it sometimes, but even that doesn't always work, and they will only resort to that after trying all sorts of other, less severe, methods, dragging things out for years, as we saw in this case. It should be possible? Perhaps, but not likely. But why should the determination of women's lives be left in the hands of men only . Remember, there are only male dayyanim on these batei din (and I don't view a change in that in the Orthodox world in the foreseeable future), and these so-called "poskim" are also all men, in the Orthodox world. It is nice to delude oneself and believe that the halakhic system can salvage itself in the matter of family law, but it can't. It is a broken system, and, as I wrote in the post, needs to be scrapped.

    2. And, I neglected to point out - no method of "enforcement" (that can't really be enforcement) is relevant outside of Israel, where the civil authorities won't get involved. Only excommunication can be done by the Jewish community, and it doesn't usually work all that well these days.

    4. אל תצטער על העברית. הלואי שכל עם ישראל יוכלו לכתוב, לקרוא, ולדבר בשפת העם, ואז הייתי מתאמצת וכותבת את הכל בעברית

      בנוגע להערה שלך, אשמח לראות ראיות לכך. כמה שידוע לי, לא הייתה סמכות לאוטונומיות היהודיות באשכנז ובקהילות באירופה המזרחית להפעיל עונש גופני. רק בספרד, לפני הגרוש, יש לנו עדויות על עונשים האלה, כמה שאני יודעת.
      כמובן, זה לא אומר שלא פסק בעד אלא לא יכלו לקיים, אבל בכל מקרה אשמח לראות את המקורות שלך

  3. By definition the halachic system is just and moral, including the halachos that deal with agnuos, but no one is forcing you or anyone else to accept it. You want to scrap it for yourself, go right ahead. How will that help those who adhere to it?

    1. This is actually the type of comment I will bother to post and respond to this one time, and then I will moderate and not post them. That's because this is not so different from what I said not to bother with, things like "you have to accept God's decree".       I readily admit that I do not subscribe to the following thesis:
      1) All of Jewish law is moral and just, by definition, because it is ordained by a moral and just God.
      2) If you think a particular aspect of halakha is not moral and just, return to rule 1.

      People who think that by definition the halakhic system is just and moral must think slavery is also just and moral, and I know that many people, even very observant Jews (and I happen to be one), believe that we have our own moral compass to tell us otherwise. We also have a command tzedek tzedek tirdof.
      So how does scrapping it help those who adhere to it? It really can't. If you insist on adhering to it and also believe it is just and moral, then why would you need any help?

    2. Eli, I'd also like to point out that in Israel people are forced to adhere to these laws - it is the only way to get married and the only way to get divorced.

    3. יתכן שבהלכה יש בעיות קשות מבחינה מוסרית. יחד עם זה, יתכן שאין לנו אפשרות מבחינה הלכתית לתקן את המעוות

      זה שיש בעיה, זה לא אומר בהכרח שקיים פתרון.

  4. אני לא רואה שהתיחסת לשאלה של סתירה בין הלכה ומוסר
    אני מבין ממראה המקום שלך, שאת שואפת למצוא פתרון כאשר נראית התנגשות בין הלכה למוסר
    עכשיו חשוב לברר, האם יש גבולות הלכתיים לפתרונות (כלומר, יתכן מצב שלא יהיה פתרון משום שהוא ינגוד את ההלכה) ואם כן, מהם הגבולות האלו

    הפתרון של אבי, למשל, הוא אינו עומד בגבולות ההלכתיים הבסיסיים, משום שהוא מתעלם מהגמרא המפורשת ש'משפחה - כיון שנטמעה נטמעה', ובלשון הרמ"א: משפחה שנתערב בה פסול ואינו ידוע לרבים, כיון שנטמעה נטמעה, והיודע פסולה אינו רשאי לגלותה אלא ינחינה בחזקת כשרות שכל המשפחות שנטמעו בישראל, כשרים לעתיד לבוא . במילים פשוטות, ממזר שאף אחד אינו יודע שהוא ממזר, למעשה האיסור פקע ממנו.

      אני אישית, כן, ואם פתרון שלי לכאורה, נוגדת את ההלכה, אני מוכנה לקחת את הסיכוי ואתווכח עם
      השופט העליון כשבא זמני לעשות כך
      אם אדם אינו שלם עם עצמו וחושב שהוא מתנהג בצורה בלתי-מוסרית או תומך במערכת בלתי-מוסרית, אז הוא הופך להיות נוול ברשות התורה האולטמטיבי

      בנוגע לפתרון של אבי, אין זה נוגד את מה שהבאת מהגמרא - למה הוא אינו עומד בגבולות אלה? פתרון זה בעצם אומר שהדברים שהבאת הם מיותרים. מה שהבאת מהגמרא ודברי הרמ"א רק פוקעים את האיסור אם אף אחד אינו יודע, אבל המערכת בישראל שומרת על פרטים של ממזרים ומפרסמים את הפרטים לבתי דין בארץ ושומרים את הפרטים במערכת, פעולה שנוגדת כל דרך פעולה בעבר ודרך שנוגדת כל אפשרות להיטמע, בטכנולוגיות שלא היו קיימות בעבר
      חלילה שנעשה דבר כזה בשם ההלכה ובשם האל הרחום והחנון, הפוקד עוון אבות על בנים רק כשהבן ממשיך בדרכו הרעה של אביו (לפי הפירוש הידוע) ולכן צריכים פתרון דרסטי כמו זה של אבי
      בכל מקרה, מה שאבי כתב מראה מצב שקיים - עובדה שכולנו צאצאים של ממזרים - וכל אחד צריך לחשוב מה המשמעות של זה לעצמו
      אתה יכול להמשיך בדרכך ההלכתי ולהתעלם מדמי אחיך הצועקים, אבל המדינה אינה רשאית לכפות את הדת הבלתי-מוסרי על כולם

    הנקודה היא, שאני מעונין בשמירה על הגבולות ההלכתיים המקובלים (ואגב, יש המגדירים איסור התבוללות או איסור על משכב זכר וכן הלאה כמעשה לא מוסרי) וכיון שכך, אין לך ולי בסיס משותף לדיון.

    אני מאמין שרוב הציבור הדתי מעונין, כמוני, בשמירת הגבולות ההלכתיים, ולכן הרבה יותר כדאי ליצור שיח בתוך הגבולות האלו ולא מחוצה להם

    (הפתרון של אבי לא נכון מבחינה הלכתית, כי אין משמעות להיות צאצא של ממזר, אם הוא 'נטמע' אין לי בעיה שאחד מהורי הוא ממזר אלא אם ההלכה קובעת שבכך אני נהפך לממזר).

  6. ייתכן שרוב הציבור הדתי מעוניין בשמירת הגבולות ההלכתיים. מטרתי היא שלפחות תעשו את זה בעניים פקוחות. ואז, אם תתעקשו, ואם חלילה יש לך בת או אחות שהיא מסורבת גט, לא תוכל לומר שלא ידעת. ליותר מאלפיים שנה המערכת ההלכתית ניסתה להתמודד עם בעיות הנובעות מנישואין כדת משה וישראל - ללא הצלחה. והיום משתמשים אפילו פחות בפתרונות שפעם כן השתמשו (כגון גט על תנאי - אם אתה מוכן לקרוא מאמר באנגלית אני מפנה אותך למאמר שכתבתי ותוכל לקבל את הביבליוגרפיה המלאה באתר academia.edu

    1. I received another reply back from טוביה שלמה בר אילן
      I chose not to post it (these are moderated comments), for the following reasons.
      His comments are really not לעניין - that is, they are not a discussion of the cases or information that is presented. Rather, he wishes to continue a debate about religion vs. morals and why he thinks the religious way of life is superior to liberal values that I promote. Debating these topics is not the purpose of this blog. If Tuvya wants to tell people how liberal values have destroyed the family unit (btw, how does polygyny square with a family unit?), or created sexual permissiveness, he could take those comments to another forum. But first I suggest that he read some history. Check out, for example, the case of Zvi Migdal. In any event, I don't want to spend any more time in such debates. I want to use my time to write more informative posts.
